TRIPOLI – Regulation No. 26 of 2024 concerning trademark practices in Libya has been released by the Minister of Commerce and Trade.
Key features of the new regulation include:
- Introduction of provisions for the registration and protection of sound marks.
- Electronic publication of accepted applications.
- Reduction of the opposition period from 60 days to 30 days.
- Adoption of the 11th Edition of the Nice Classification.
- Implementation of new increased official fees.
- Restriction of trademark protection to the specific version applied for; for instance, applications with a black-and-white trademark will only safeguard the black-and-white rendition, excluding other colored variations. The mark in use must be identical to the applied-for mark.
This decree, published on January 17, 2024, is set to become effective 30 days from the date of publication.
