In a significant move towards enhancing its intellectual property landscape, the Arab Republic of Egypt took a crucial step by enacting Law No. 163 of 2023 on August 13, 2023. This landmark legislation heralds the establishment of the Egyptian Authority for Intellectual Property (EAIP), a specialized body entrusted with fostering the growth and protection of Intellectual Property Rights (IPRs) in the country, all while aligning with Egypt’s commitment to sustainable development goals.

The primary objective of the EAIP is to streamline the intellectual property system in Egypt, fortifying it to meet international standards and obligations while driving the nation’s sustainable development aspirations. The EAIP is poised to supplant various ministries and entities related to higher education and scientific research, culture, trade and industry, telecommunications and information technology, and more, as designated in the laws overseeing IPRs and their corresponding regulations, notably Law No. 82 of 2002 concerning the Protection of Intellectual Property Rights.

Under the provisions of the newly enacted law, the EAIP is tasked with executing its designated responsibilities within a year of the law’s enactment. An extension of up to six months can be granted by a Prime Ministerial Decree, if necessary, to ensure a seamless transition.

The EAIP’s core functions encompass a wide array of activities aimed at refining Egypt’s intellectual property landscape. Some key functions include:

  1. Formulating National Strategy: The EAIP will be responsible for crafting and regularly updating a comprehensive national strategy for intellectual property. This strategy will serve as a roadmap for the systematic development of IPRs in the country.
  2. IPR Registration and Protection: The EAIP will handle the registration, filing, and issuance of documents related to the protection of IPRs, such as patents and trademarks.
  3. Integrated Databases: It will establish comprehensive databases to enhance the intellectual property system’s efficiency, accessibility, and effectiveness.
  4. Encouraging Innovation: The EAIP will actively encourage inventors, creators, investors, startups, and SMEs to register their intellectual property to secure protection and optimize their benefits.
  5. Economic Exploitation of IP Assets: The EAIP will develop strategies to evaluate and capitalize on state-owned intellectual property assets, while also educating the private sector on effectively leveraging intellectual property assets for economic gains.
  6. Register Maintenance: It will create and maintain registers for patent and trademark owners, ensuring transparency and accessibility of crucial information.
  7. Raising Awareness: The EAIP will play a pivotal role in educating the public about the significance of intellectual property and its positive impact on innovation and economic growth.
  8. International Collaboration: The EAIP is mandated to collaborate with international and regional organizations responsible for safeguarding IPRs, fostering a robust global network for intellectual property protection.
  9. Policy Input: The EAIP will contribute valuable insights and recommendations on proposed laws connected to the protection of intellectual property rights.
